JobAware Terms of Service

Effective: November 22, 2017

JobAware is a web and mobile application for job seekers and companies. JobAware aims to educate people on various aspects of the process of job search in addition to providing them with powerful job search tools. These terms of use ("Terms of Use") apply to your use of the JobAware mobile application and the JobAware website at jobaware.com (combined, the "JobAware Service" or "Service"). The JobAware Service is owned by TapAware, LLC ("JobAware" or the "Company").

Copyright

With exception for the Partner Content (defined below) all text, graphics, user interfaces, trademarks, logos, sounds and artwork in the JobAware Service are owned, controlled or licensed by JobAware, and are protected by copyright, patent and trademark laws, and various other intellectual property rights laws.

Except as expressly stated in these Terms of Use, no part of the JobAware Service and no content may be copied or reproduced in any way to any other computer, server, device, website or other medium for publication or distribution or for any commercial enterprise, without JobAware's express prior written consent.

JobAware respects the intellectual property rights of others. If you believe that JobAware is infringing on your copyrights, please contact info@jobaware.com with substantial information regarding your claim.

Partner Content

As a function of the Service we display content provided by third parties (the "Partner Content"). Partner Content consists of, but is not limited to text, images, videos, logos and names associated with any partner companies (the "Partner", collectively, the "Partners"). A Partner is any company that agrees to provide JobAware Partner Content. Partner Content includes any content retrieved through any Partner's application programming interface. JobAware's use of Partner Content does not represent any endorsement or recommendation by any Partner.

There are links to third party websites in the JobAware Service. We provide these links solely for your use and convenience. The link does not represent any endorsement or recommendation by JobAware and does not indicate that we have any association with the linked website. We are not responsible for the content of any linked websites and we do not accept liability for any loss, damage, expense, costs or liability whatsoever that you may incur, should you enter into a contract with the third parties that operate these websites.

JobAware respects the agreements of its Partners. If you believe that JobAware is in violation of your agreement, please contact info@jobaware.com.

Disclaimer, Warranties and Indemnification

JobAware does not bear responsibility and will not be liable for any economic loss, loss of goodwill or reputation, loss of information or any other loss or damage of any kind, even if that loss or damage was foreseeable, which occurs during use of the Service.

JobAware reserves the right, at its sole discretion to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the JobAware Service following the posting of changes will mean that you accept and agree to those changes.

Although the JobAware Service makes a concerned effort to display accurate content, it has no control over, or responsibility for, authenticity and accuracy of the Partner Content provided by its Content Partners. The JobAware Service and its content are therefore provided without any guarantees, conditions or warranties for accuracy.

You agree that no content, advice or information obtained by you and provided by JobAware or through your use of the JobAware Service shall create any warranty not expressly stated in the Terms of Use.

As a measure to provide for product improvements and to enable user feedback, JobAware reserves the right to anonymously track and report a user's activity within the Service.

JobAware also makes no warranty that the Service will meet your requirements or will be uninterrupted, timely, secure, or error-free.

You agree to defend, indemnify, and hold JobAware, its officers, directors, employees, agents and Partners, harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with (i) your access to or use of the JobAware Service and its content; (ii) your violation of these Terms of Use; or (iii) your violation of any third party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right.

If you believe there have been any violations of these Terms of Use or have any suggestions or comments, then please email us at info@jobaware.com. By offering unsolicited advice, suggestions or comments, you agree to give up your right to the intellectual property rights in the content you provide and that the content you provide becomes the property of JobAware. You agree that JobAware acquires all intellectual property rights, title and interest of any advice, suggestions or comments you provide through your correspondence with JobAware.
